Terms and Conditions

 
1.     Introduction

 

These are the terms and conditions that apply when you order a Home Information Pack ( hereafter abbreviated to HIP ) or an Energy Performance Certificate ( hereafter abbreviated to EPC) from Wirral Precision HIPs ( hereafter abbreviated to WPH ) for a domestic property. If there is anything that you are unclear about with regard to these terms and conditions, then please do not hesitate to seek clarification from WPH prior to ordering.

 

2.     About WPH

 

Wirral Precision HIPs stands for Wirral Precision Home Information Packs and is based at 4 Arroweside, Greasby, Wirral, Merseyside CH49 2PB

 

3.      Services

 

WPH carry out energy assessments on domestic properties, mainly in Wirral, and produce EPCs using the data collected. HIPs are compiled, of which the EPC is a component part. Follow-up EPCs are also offered to customers who wish to quantify their energy savings further.

 

4.     Commissioning

 

Any person legally capable of entering into a binding contract and at least 18 years of age can commission either a HIP or an EPC. Upon receipt of property details ( see clause 7 ) by mail, e-mail, web site or phone, a quotation will be provided by mail, e-mail or phone which will include the time and date of the energy assessment ( which will be by mutual agreement ) and the total price for the HIP or EPC. The quotation will be valid for 30 days.

 

 5.     Payment

 

Payment will be by cash, cheque, debit/credit card or paypal and will be payable, in full, on the date of the assessment. A deferred payment may be possible, but will only be permissible if confirmed in writing by WPH. Payments by debit/credit card or deferred payments will incur an extra charge.

 

6.     Rights of Cancellation

 

You have a right to cancel an order at any time, for any reason, up to the agreed date of the energy assessment. Unless payment has been made prior to the date of the assessment, the third party components of the HIP will not be ordered until the date of the assessment.

 

7.     Property Information

 

The price of the HIP/EPC is based on information you give to us and as such relies on this being accurate. If this information is found to be inaccurate, an example being that a property turns out not to be registered after we have been advised by you that it is, then we reserve the right to amend the price accordingly.

 

8.     Information from third parties

 

 In compiling a HIP we reserve the right to obtain documents from third parties using our best judgement as to who is suitably qualified and has the necessary expertise to provide these documents. We cannot be held responsible therefore for any errors or omissions in such documents. We ensure that all our suppliers carry sufficient insurance cover.

 

9.     Our Liability

 
We are not liable for any use of the EPC/HIP or any information contained within the EPC/HIP by third parties once the product is made available to the public. We are not liable for any loss of income or revenue, loss of profits, loss of contracts, loss of data, loss of time or any consequential loss or damage of any kind whether caused by breach of contract, negligence or otherwise.

 

10.      Cancellation

 

We reserve the right to withdraw, for any reason, any quotation for a HIP or EPC at any time prior to the date of carrying out an assessment. We will do this in writing by mail, e-mail or phone and if any monies have been taken these will be returned in full.

 

11.      Force Majeure

 

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract caused by events outside our reasonable control.

 

12.      Jurisdiction

 
These terms and conditions and any contracts for the purchase of HIPs or EPCs from WPH will be covered by English Law.

 

13.      Severability

 
If any of these terms and conditions or any of the provisions of a contract are deemed by any competent authority to be invalid, unlawful or unenforceable, such term, condition or provision will to that extent be severed from the remaining terms and conditions, which will continue to be valid to the fullest extent permitted by law.
